Terms & Conditions
By completing an enrolment form, booking form, Direct Debit Authority, attending lessons, or continuing enrolment with Daleys Point Swim School, you acknowledge that you have read, understood and agree to the following Terms and Conditions.
Daleys Point Swim School reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated via email.
1. Privacy Policy
Daleys Point Swim School is committed to protecting the privacy and personal information of its customers.
Personal information collected during enrolment will only be used for the administration of swimming lessons, communication regarding your enrolment, and information relating to our services, programs and promotions.
Personal information will not be disclosed to third parties except where required by law or where necessary to provide services associated with your enrolment.
2. Enrolment & Term Commitment
Enrolments are accepted on a term basis and reserve a position in a class for the entire school term.
By completing a booking form, enrolment form and/or Direct Debit Authority, the responsible person agrees to enrol their child for the full term and accepts responsibility for payment of all fees associated with that term.
Places within our program are limited and are reserved exclusively for enrolled students. Staffing, class allocations and operational requirements are based on confirmed enrolments for the term.
A reserved class position cannot be transferred, paused, suspended, placed on hold or deferred during a term.
Failure to attend lessons does not constitute cancellation and does not release the customer from their obligation to pay fees for the term.
3. Cancellation Policy
Direct Debit
Direct Debit is the primary method of payment at Daleys Point Swim School
By providing your Direct Debit details, you authorise Daleys Point Swim School to debit your nominated account or card for all fees owing in accordance with these Terms and Conditions.
Payments will be processed fortnightly on Tuesdays and collected four (4) weeks in advance.
Cash Payments
Cash payments will only be accepted during the first week of each school term and must cover the full term fees.
Cash payments will not be accepted after the first week of term.
Fee Changes
Daleys Point Swim School reserves the right to adjust lesson fees. Reasonable notice will be provided prior to any fee increase.
4. Failed Payments & Outstanding Accounts
The account holder is responsible for ensuring sufficient funds are available for all scheduled direct debit payments.
Any dishonour fees charged by our payment provider, bank or merchant facility will be passed on to the customer.
Daleys Point Swim School reserves the right to charge an administration fee for failed payments.
Accounts that remain unpaid may result in:

Suspension from lessons;
-
Removal from class enrolments;
-
Loss of reserved class positions;
-
Loss of access to make-up lessons;
-
Loss of access to class transfers and booking changes.
Make-up lessons, class transfers, credits and booking changes are not available to accounts with overdue balances.
Where a customer withdraws during a term, any unpaid fees relating to the remainder of the term become immediately due and payable.
5. Class Availability
Class positions are limited and cannot be guaranteed until all fees owing are paid.
Daleys Point Swim School reserves the right to offer vacant positions to other customers where accounts remain overdue.
Continued non-payment may result in the cancellation of enrolment and referral of the outstanding balance for debt recovery.
6. Cancellation Policy
All cancellation requests must be submitted in writing via email.
Written notice of cancellation must be received no later than fourteen (14) days prior to the commencement of the next term.
Enrolments are for the full term. Once a term has commenced, no refunds, credits, reductions in fees or transfers will be provided for withdrawals during that term.
Failure to attend lessons does not constitute cancellation.
Where a customer withdraws during a term, all remaining fees for that term remain payable.
Daleys Point Swim School may, at its sole discretion, consider a credit in exceptional circumstances such as serious illness or injury preventing participation for the remainder of the term. Supporting documentation may be required.
Any approved credit must be used within six (6) months of the issue date and is not redeemable for cash.

7. Missed Lesson & Make Up Lessons
Make-up lessons are available only when:

The absence is recorded through the Swim School App prior to the lesson commencing; and
-
The account is fully paid and up to date.
Make-up lessons:
-
Are subject to availability;
-
Expire sixty (60) days after the missed lesson;
-
Have no cash value;
-
Cannot be transferred to another student.
Make-up lessons are available for approved absences and Public Holiday closures only where the account is fully paid and up to date.
No make-up lessons will be provided for overdue accounts.
No refunds or credits will be provided for missed lessons.
8. Changes to Classes
Daleys Point Swim School reserves the right to:

Change instructors;
-
Alter class times;
-
Consolidate classes;
-
Merge classes;
-
Cancel classes;
-
Change lesson locations where required.
Where possible, notice of significant timetable changes will be provided.
9. Swim School Closures & Public Holidays
Lesson fees are based on a student's reserved position within the program and not solely on attendance at individual lessons.
Lessons do not operate on Public Holidays unless otherwise advised.
Where a lesson falls on a Public Holiday and the account is up to date, a make-up lesson will be added to the student's account and may be booked subject to availability.
Public Holiday make-up lessons are subject to the same conditions as all other make-up lessons and must be used within sixty (60) days of the missed lesson unless otherwise approved by Daleys Point Swim School.
No cash refunds, credits or fee reductions will be provided for Public Holiday lessons.
Daleys Point Swim School may close due to maintenance, equipment failure, emergency situations, extreme weather, staff illness, government directions or other circumstances beyond our reasonable control. In these circumstances, Daleys Point Swim School may, at its sole discretion, provide a make-up lesson, account credit or alternative class.
Make-up lessons, credits and booking changes are only available to accounts that are paid in full and up to date.
10. Parental Supervision

A parent or responsible adult must remain on-site for the duration of all swimming lessons, regardless of the child's age.
Parents and guardians must remain immediately contactable throughout the lesson.
Students may only be handed to and collected from a responsible adult.
Failure to comply with supervision requirements may result in suspension or cancellation of enrolment.
11. Code of Conduct
All students, parents and visitors are expected to behave respectfully towards staff, students and other families.
Daleys Point Swim School reserves the right to refuse entry, suspend lessons or cancel enrolments where behaviour is deemed inappropriate, unsafe, abusive, threatening or disruptive.
No refund or credit will be issued where an enrolment is terminated due to breaches of the Code of Conduct.
12. Health & Safety
Students must not attend lessons if suffering from a contagious illness, including but not limited to:

Gastroenteritis;
-
COVID-19;
-
Influenza;
-
Conjunctivitis;
-
Head lice;
-
Cold sores;
-
Fever;
-
Ringworm;
-
Any other communicable disease.
Warts and Molluscum Contagiosum must be fully covered with a waterproof dressing prior to entering the pool for the safety of staff and other patrons.
Daleys Point Swim School follows NSW Health recommendations regarding healthy swimming practices.
13. Clothing & Aqua Nappies
All students must wear appropriate swimwear.
Children under three (3) years of age, or those not fully toilet trained, must wear an approved aqua nappy while participating in lessons.
14. Medical Treatment
In the event of an illness, injury or emergency, parents and guardians authorise Daleys Point Swim School staff to seek medical treatment deemed necessary for the safety and wellbeing of the student.
Any associated costs remain the responsibility of the parent or guardian.
15. Liability
Participation in swimming lessons involves inherent risks.
Daleys Point Swim School accepts no responsibility for injury, loss, damage or theft sustained while attending lessons except where required by law.
Parents and guardians acknowledge and accept these risks upon enrolment.
16. Debt Recovery
The customer agrees to pay all reasonable costs incurred by Daleys Point Swim School in recovering outstanding debts.
This includes but is not limited to:

Debt collection agency fees;
-
Legal fees;
-
Court filing fees;
-
Administrative costs;
-
Interest where permitted by law.
Outstanding accounts may be referred to a debt recovery agency without further notice.

17. Photography & Recording
Photography and video recording within the facility must not interfere with lessons or the privacy of other patrons.
Daleys Point Swim School may occasionally take photographs or videos for promotional purposes. Consent preferences may be indicated on the enrolment form.
18. Parking & Facility Rules
Customers must park only in designated parking areas. Parking is available in front of the centre and in designated areas as directed by staff.
Parking on lawns, landscaped areas or areas not designated for parking is not permitted.
Customers must comply with all directions provided by staff.
Daleys Point Swim School accepts no responsibility for loss, theft or damage to vehicles or personal property while attending the facility.
19. Communication
Daleys Point Swim School uses email as its primary method of communication.
It is the responsibility of the account holder to ensure that all contact details, including email address, mobile number and billing information, remain current and accurate.
Notices, invoices, statements, fee reminders, policy updates and other communications sent to the email address recorded on the account will be deemed received by the account holder unless otherwise notified in writing.
Failure to read or receive communications does not waive any obligations under these Terms and Conditions, including payment obligations.
20. Chargeback & Payment Disputes
Where a customer initiates a chargeback, payment reversal or payment dispute for fees validly owed under these Terms and Conditions, Daleys Point Swim School reserves the right to suspend enrolment until the matter is resolved.
The customer agrees to reimburse Daleys Point Swim School for any fees, charges or costs incurred in responding to or defending a chargeback or payment dispute.
21. Acceptance of Terms
By completing an enrolment form, booking form, Direct Debit Authority, attending lessons or continuing an enrolment, the responsible person acknowledges that they have read, understood and agree to these Terms and Conditions.
The responsible person further acknowledges that enrolment constitutes a commitment for the full term and that all fees associated with that term remain payable in accordance with these Terms and Conditions.
